TestPest AI — Privacy Policy

This is the plain-language version, and it is the real policy. No dense legal wall. If something here is unclear, email testpestai@gmail.com and we will explain it.
The short version
- We do not show ads. Ever. In any tier.
- We do not sell your data. We do not rent it, trade it, or hand it to data brokers.
- We collect the minimum we need to run your account, show your progress, and make the practice smarter.
- You can download or delete your data at any time.
- You must be 14 or older to have a student account.
1. Who we are
TestPest AI (testpestai.com) is a free study platform for the SAT®, ACT®, PSAT®, and AP® exams, operated by VALA Web Design & Marketing, Inc. of Jacksonville, Florida. Contact: testpestai@gmail.com.
2. What we collect
You give us:
- Account basics: email, display name, password (stored hashed — we never see it).
- Optional profile details: school, grade level, target exam, target score, bio, avatar and Pesty customization.
- Things you type or upload: practice answers, essays and free-response work, notes and study materials you upload, score reports you upload, tutor chat messages, feedback, and question reports.
We generate as you study:
- Which questions you saw, what you answered, whether it was right, and how long it took.
- Derived study data: accuracy by topic, weak topics, estimated ability, XP, coins, streaks, and badges.
We collect automatically:
- Basic technical data needed to serve the site: IP address, browser type, device type, and timestamps.
- Simple product analytics: which pages and features get used, so we know what to fix.
We do not collect: your government ID, your Social Security number, your precise location, payment card numbers (any donation or paid-plan card details go straight to Stripe, not to us), or biometric data.
3. Why we use it
- To create and run your account, keep you signed in, and keep it secure.
- To show your progress, scores, streaks, and score reports.
- To pick your next question and personalize practice around your weak topics.
- To power the AI tutor and AI explanations and grading.
- To send the emails you asked for (verification, password resets, study reminders, progress digests).
- To detect abuse, cheating, and fraud, and to keep the service running.
- To understand aggregate usage so we can improve the product.
We do not use your data for behavioral advertising, and we do not build advertising profiles.
4. AI and your data
When you use the AI tutor, AI explanations, or AI grading, the relevant text (your question, your answer, and enough study context to be useful) is sent to our AI provider to generate a response. Your content is not used to train third-party foundation models. We cache generated explanations so the same explanation can be reused by other students — those cached explanations are about the question, not about you.
AI output can be wrong. Scores and feedback from AI are practice estimates, not official scores.
5. Who we share with
We share only with the service providers we need to operate, and only what they need:

We may also disclose information if legally required, to protect someone's safety, or as part of a business transfer (in which case this policy follows the data).
We never sell or rent personal information, and we do not share it for cross-context behavioral advertising.
6. What other people can see
- Your display name, avatar or Pesty, school, grade, target exam, and aggregate stats (XP, accuracy, attempts) appear on public profiles and leaderboards.
- Your friends see your stats. Your individual answers, essays, uploads, and tutor chats are never shown to other students.
- If you join a class, your teacher sees your assignment results and progress in that class.
- If you link a parent, tutor, or counselor, they see your progress and score reports. Only you can create that link, and you can revoke it at any time from Settings. A persistent indicator shows you whenever a parent link is active.
7. Cookies
We use cookies and local storage for sign-in sessions, remembering your theme and preferences, and basic analytics. We do not use advertising or cross-site tracking cookies. Details are in our Cookie Policy.
8. Your choices and rights
- See your data: most of it is visible in your dashboard, profile, and score reports.
- Fix it: edit your profile in Settings at any time.
- Export it: email us and we will send you a copy.
- Delete it: Settings has "Delete my account." We remove your personal data within 30 days. Aggregate, de-identified statistics (like how often a question is answered correctly) remain, because they are no longer tied to you.
- Emails: unsubscribe from any study email with the link at the bottom, or turn them off in Settings. Account-critical emails (verification, password resets) still go out.
If you are in California, the EU/UK, or another region with privacy rights, you have rights to access, correct, delete, and port your data, and to object to certain processing. Email testpestai@gmail.com and we will honor them. We will not discriminate against you for exercising any of these rights.
9. Students under 18, and the 14+ minimum
You must be 14 or older to create a student account, and we ask you to confirm that at sign-up. We do not knowingly collect information from anyone under 14. If we learn we have, we delete the account and its data. Parents or guardians who believe a child under 14 has signed up should email testpestai@gmail.com.
If your school or district uses TestPest, we act as a service provider to that school under FERPA and applicable state student-privacy laws: school data is used only to provide the service to that school, never for advertising, and never sold.
10. Security and retention
Data is encrypted in transit and at rest, access is restricted, and database row-level security keeps your records scoped to you. No system is perfectly secure, but we treat student data as sensitive by default. We keep your data while your account is active, then delete it within 30 days of a deletion request, except where we must keep records to comply with the law.
Our servers are in the United States. If you use TestPest from elsewhere, your data is processed in the US.
11. Changes
If we change this policy in a way that matters, we will update the date above and tell you in the product or by email. Continuing to use TestPest after a change means you accept it.
